Singer Nick Carter has dropped a bombshell new piece of evidence in a sexual assault case currently being heard against him, claiming that he was thousands of miles away when one of the alleged assaults took place.
The Backstreet Boys lead has been in litigation since 2023 over a woman's claims that he carried out three sexual assaults against her in 2003. Ashley Repp claims these attacks took place when she was aged just 15.
45-year-old Carter, who refutes all the allegations against him, presented evidence to the court this week that he was 2,500 miles away when one of the assaults is said to have taken place, according to an Us Weekly report.

Repp had told investigators that the dates she reported being assaulted on were 'approximations' and not exact. But on Wednesday (January 7), his legal representatives asked for the case to be thrown out of court while arguing that his accuser is 'desperate for money and attention'.

Repp alleges that during the incidents Carter had 'continued to engage in sexual intercourse with [Repp] despite her repeated refusals and requests for him to stop'.
But his lawyers have shot back by pointing to 2004 testimony from Repp that she 'deceived Carter and others about her age and admitted that her sexual encounters with Carter were consensual'.
After having three women come forward with claims of past abuse Carter has claimed that Repp, who has been characterized as a fan of the boyband, and two other accusers, Shannon Ruth and Melissa Schuman, are conspiring against him to get a financial settlement.
Repp claims that one of the assaults took place on October 27, 2003, while she was on a yacht in Marathon, Florida, alleging that the singer carried out sexual battery, intentional infliction of emotional distress and negligent infliction of emotional distress during the attacks.
However, Carter's lawyers said the date could not be correct, arguing: “Repp has not wavered from the October 27, 2003 date, which was confirmed and reconfirmed in her Complaint, her Declaration dated June 14, 2024, and her verified discovery responses."

They continued: "Even during her deposition, Repp was adamant that she was violently sexually assaulted by Carter on October 27, 2003 and that it was ‘absolutely not’ possible that this date was incorrect.”
The submission to the court claims the Backstreet Boys singer 'was over 2,500 miles away from Florida attending the 2003 Radio Music Awards in Las Vegas, Nevada,' when the attack is said to have took place.
They said that pictorial evidence from the event shows that Carter was there on both October 27 and the day before.
When the pop singer's lawyers brought this up during Repp's deposition, his team alleges that she froze, and responded: “Again, I was almost certain that the date was October 27, 2003. . . . It is quite possible that I may have gotten that date incorrect.”
After the lawyers press her further, she added: “I’m not changing my testimony that I was sexually assaulted a third time. I will agree that I am not perfect. And, you know, I’ve been fairly good with getting exact dates correct.”
His legal team added: “Ultimately, Repp conceded that it was impossible for Carter to have assaulted her on October 27, 2003, as she had alleged in her Complaint, and confirmed in sworn testimony many times since.”
