Police issue major update after TikTok star Emilie Kiser files lawsuit following death of 3-year-old son in family pool

Chandler Police shared an update following an investigation into the death of three-year-old Trigg Kiser

Chandler Police have issued a huge update in the case of Trigg Kiser, the three-year-old son of TikTok star Emilie Kiser and her husband Brady, after the little boy sadly drowned.

The toddler was found unresponsive in the family pool in Arizona while his father Brady was allegedly at home with him and his three-month-old brother Theodore on May 12.

The young boy later died in hospital on May 18.

Their mother, Emilie, who has 4.1 million TikTok followers and 1.7 million Instagram followers, was out with friends at the time.

According to search warrant applications obtained by The Arizona Republic, Brady claimed Trigg went out into the backyard to play after he had finished eating.

The father than said he noticed Trigg playing near the pool, which police records showed was 'not uncommon'.

He also told police that the pool 'usually' had a protective cover over it, according to the records.

Brady said he was 'soon distracted' by baby Teddy, the records said, and he took his eyes off Trigg for 'three to five minutes'.

He then said he found his son floating in the pool, jumped in to rescue him and then called 911.

Police attended and performed CPR before firefighters arrived and took over.

On July 16, Chandler Police issued a shocking update on Twitter, saying they had completed their investigation and recommending charges be brought.

They wrote: "We have completed our investigation into the tragic drowning of three-year-old Trigg Kiser. After a thorough review of the evidence, we have submitted the case to the Maricopa County Attorney's Office for further review and any potential prosecutorial decisions."

The shared graphic elaborated: "Felony child abuse charge recommended in drowning of Trigg Kiser.

"The Chandler Police Department has completed its investigation into the tragic drowning of three-year-old Trigg Kiser, who died May 18, 2025, after being found unresponsive in his family's backyard pool."

"Following a thorough review of the evidence, investigators have recommended a Class 4 felony charge of child abuse against Brady Kiser."


The news follows Emilie's lawsuit filing on May 27, asking the court to block the release of records about Trigg’s death.

In May, a judge ruled in favour of Emilie to give her temporary confidentiality on her request for privacy 'until a determination is made that balances the public’s need for information vs privacy interests', according to court documents obtained by Us Weekly.

Emilie's attorneys said she and her family 'desperately want to grieve in private, but sadly, the public will not let them'.

The lawsuit filing added: "Emilie is trying her best to be there for her surviving son, two-month-old Theodore, but every day is a battle."

They said the release of documents, including crime scene photos, the 911 call, surveillance footage of the incident, body camera footage, and autopsy reports would 'intrude upon personal dignity or cause unnecessary harm' to the family.

Brady Kiser could now face felony charges following the recommendation from Chandler Police.
