Trump administration claims judge cannot return father who was accidentally deported to 'world's worst prison' due to 'error'

Donald Trump's administration is claiming a judge does not have the authority to order the government to return a father who was sent to El Salvador's notorious mega prison by mistake.

The Center for Terrorism Confinement is well known for housing Venezuelan gang members, as well as mass murderers, with over 250 alleged criminals having been deported to El Salvador’s mega prison over the years.

The prison, also known as the CECOT, is considered the largest prison in the Americas and can home up to 40,000 inmates.

So, where does Trump fit into this?

Well, the president's team has recently acknowledged an 'administrative error' on their behalf, which saw a Maryland father with protected legal status be accidentally deported to El Salvador.

A court filing has come to fruition from a lawsuit over the removal of Kilmar Armando Abrego Garcia, a Salvadoran national, after he was granted protected status by an immigration judge back in 2019.

Essentially, this status should have prohibited the federal government from sending him to the nation.

The filing, revealed on March 31, said: "On March 15, although Immigration and Customs Enforcement (ICE) was aware of his protection from removal to El Salvador, Abrego Garcia was removed to El Salvador because of an administrative error."

In a new development, the Trump administration's attorneys have asked the 4th US Circuit Court of Appeals to halt a Friday (April 4) ruling by District Judge Paula Xinis.

The judge ordered the government to 'facilitate and effectuate' Kilmar Abrego Garcia’s return to the US following the recently confessed mishap.

"A judicial order that forces the Executive to engage with a foreign power in a certain way, let alone compel a certain action by a foreign sovereign, is constitutionally intolerable," the attorneys wrote.

Justice Department attorney Erez Reuveni has since been placed on leave by the Justice Department after stating Abrego Garcia should not have been sent to the notorious prison or been removed from the US.

Attorney General Pam Bondi said in a statement: "At my direction, every Department of Justice attorney is required to zealously advocate on behalf of the United States. Any attorney who fails to abide by this direction will face consequences."

Meanwhile, Simon Sandoval-Moshenberg, who is acting as Abrego Garcia’s attorney, has claimed the government isn't doing much to facilitate a return despite admitting to the mistake.

"Plenty of tweets. Plenty of White House press conferences. But no actual steps taken with the government of El Salvador to make it right," he told the judge.
